LEGAL: In Mexico, the General Law on Linguistic Rights of Indigenous Peoples, along with the Constitution and other legal frameworks, recognizes the right of indigenous peoples to preserve their traditions, including their spiritual practices and the use of sacred medicines in ritual contexts. However, the legality of conducting ceremonies with ancestral medicines depends on several key factors:

Recognition of Indigenous Customary Law

Article 2 of the Mexican Constitution establishes that indigenous peoples have the right to preserve their normative systems and traditional practices, as long as they do not violate fundamental rights or constitutional provisions.

Regulated Substances and Traditional Medicine

However, the use of these substances by non-indigenous individuals or outside ritual settings may be penalized.
